UPDATE: 5/19/2023 - SB 2632 is eligible for a vote in the Senate as of 5/21/2023. The committee substitute expands the bill to cover all food containing mRNA vaccine material instead being limited to meat food products containing mRNA vaccine material. This substitute required a title change for the bill on the portal from "Prohibits meat food product made from livestock injected with mRNA vaccine from being sold in TX unless conspicuously labeled" to "Prohibits food containing mRNA vaccine material from being sold in TX unless conspicuously labeled."

SB 2632 was introduced on 5/10/2023. This bill is sponsored by Senator Bob Hall and co-sponsored by Senators Bettencourt, Campbell, Hughes, Kolkhorst, Middleton, Parker, Perry, and Sparks.
SB 2632 amends the Texas Food, Drug, and Cosmetic Act (Chapter 431 subchapter D on Food) and the Texas Meat and Poultry Inspection Act Code (Chapter 433 Subchapter C on Labeling and Other Standards) both within the Health and Safety Code with new sections to prohibit a person from selling a meat food product in Texas that is derived from livestock injected with an mRNA vaccine unless the product ’s label includes a clear and conspicuous notice that the product contains mRNA vaccine material.
The definition for "livestock" is already defined in state law (433.003 (11)) to mean cattle, bison, sheep, swine, goats, horses, mules, other equines, poultry, domestic rabbits, exotic animals, or domesticated game birds.
The definition for "meat food product" is already defined in state law (433.003 (13)) to mean a product that is capable of use as human food and that is made in whole or part from meat or other portion of the carcass of livestock, except a product that:
(A) contains meat or other portions of the carcass only in a relatively small proportion or that historically has not been considered by consumers as a product of the meat food industry; and
(B) is exempted from the definition of meat food product by department rule under conditions assuring that the meat or other portions of the carcass contained in the product are unadulterated and that the product is not represented as a meat food product.
SB 2632 defines "mRNA vaccine material" to mean a substance included in a vaccine to stimulate the production of antibodies and provide immunity against disease by introducing messenger ribonucleic acid (mRNA) that corresponds to a viral protein.
The bill also directs the commissioner of the Health and Human Services Commission shall adopt rules necessary to implement the changes in law made by this Act.
The effective date of this bill if enacted is September 1, 2023.
