UPDATE: 5/9/2023 - SB 131 was enacted. Its was signed by Governor Laura Kelly on 5/9/2023. This act shall take effect and be in force from and after its
publication in the statute book.
SB 131 was introduced 2/1/2023, sponsored by Senator Jeff Pittman, Senator John Doll, and Senator Renee Erickson. The original bill was two pages long and primarily addressed out of state health care providers treating athletes on traveling sports teams. This topic was outside the scope of NVIC's area of interest and not posted on the portal. The 3/27/2023 amendment which authorized pharmacy technicians to administer vaccines triggered NVIC's interest in posting this bill and drawing attention to this portion and posting a position of OPPOSE. Some of the other new language covered licensing requirements and NVIC takes no position on the portions of the bill that are not related to vaccines. UPDATE: 4/27/2023 - The Conference Committee Report was adopted by the House by a vote of 118 Yea, 4 Nay, and by the Senate by a vote of 38 Yea, 2 Nay. During the Conference Committee process, more than 35 pages were added to the bill, primarily addressing licensing requirement for certain healthcare professions.
UPDATE: 3/28/2023 - The Senate nonconcurred with the amendments and a conference committee was requested. Three Senators and three Representatives were appointed as conferees.
UPDATE: 3/27/2023 - The House had an Emergency Final Action and passed SB 131 as amended on 3/27/2023 by a vote of 114 Yea, 9 Nay
UPDATE: 3/27/202- The Committee on the Whole adopted an amendment offered by Representative John Eplee which added pharmacy technicians who are 18 years of age or older to the list of those authorized in Kansas to administer influenza shots to children 6 years or older and non-influenza vaccines to children 12 years and older. Already in Kansas, pharmacists, pharmacy students, and pharmacy interns are authorized to administer the same vaccines. In the Supplemental Notes for this amendment, there is a record that a representative for the Kansas Pharmacists Association provided testimony to the House Committee of the Whole stating that the bill would allow pharmacy technicians to continue to administer vaccinations after completing training as had been permitted under the federal Public Readiness and Emergency Preparedness Act (PREP Act) after it expires in October 2024.
