The bill prohibits immunization status requirements for individuals or household members who are being evaluated for adoption or foster care. More specifically, SB 272 prohibits licensed child placing agencies from:

  • requiring, as a condition for obtaining an adoption, that an individual or a member of the individual's household receive an immunization;
  •  discriminating against an individual or any member of the individual's household with respect to immunization status or refusing to receive an immunization; 
  • requires the department of child services to assess certain penalties in certain circumstances; and 
  • provides that immunization status or the refusal to receive an immunization do not constitute a sufficient basis to deny a foster home license application.
