UPDATE: 8/16/2023 - SB 49 was ENACTED after Governor Roy Cooper's veto was overridden by a vote of 27 Ayes, 18 Noes in the Senate and a vote of 72 Ayes and 47 Noes in the House on 8/16/2023; effective 8/16/2023; Ch. SL 2023-106

UPDATE: 7/7/2023 - A capitol staffer explained that the legislature will continue to meet until the budget bill is passed as there is no specified adjournment date. To override a governor's veto, 60% of the present members in both chambers must vote to override. Before voting, SB 49 would first have to be placed on the calendar for both House and Senate. Any veto override would require calls to legislators and the Committee on Rules, Calendar, & Operations of the Senate. 

UPDATE: 7/6/2023 - SB 49 was referred to the Committee on Rules, Calendar, & Operations of the Senate on 7/6/2023.  

UPDATE: 7/5/2023 - SB 49 was vetoed by Governor Roy Cooper on 7/5/2023. His veto statement can be viewed HERE. Governor Cooper's statement focused on one narrow aspect of SB 49, a 12-page bill that covered many aspects of parental responsibility and care for their children. NVIC supports an override of the governor's veto as it would enable parents to make vaccine choices for their children without state interference.  NVIC takes no position on other sections of the bill.

UPDATE: 6/29/2023 - The Senate voted to concur with the current version of SB 49 on 6/29/2023 by a vote of 26 Ayes, 13 Noes, 11 Absent. It was ordered enrolled. Contact Governor Roy Cooper, ask him to SIGN SB 49. Contact page for governor is here.

UPDATE: 6/29/2023 - SB 49 is placed on the Senate calendar for 6/29/2023. 

UPDATE: 6/28/2023 - SB 49 passed the House Third Reading and was engrossed on 6/28/2023. 

UPDATE: 6/28/2023 - SB 49 was amended and passed the House Second Reading by a vote of 66 Ayes, 47 Noes, 7 Absent on 6/28/2023. The amendment changed the effective date from July 1st, 2023 to August 15th, 2023. 

UPDATE: 6/21/2023 - SB 49 was referred to the Committee on Rules, Calendar, & Operations of the House on 6/21/2023.

UPDATE: 6/21/2023 - SB 49 had a committee substitute which was passed by the House Committee on Education K-12 on 6/21/2023. The committee substitute did not change any language regarding vaccines; NVIC continues to SUPPORT SB 49.

UPDATE: 6/13/2023 - SB 49 was referred to the House Committee on Education K-12 on 6/13/2023.

UPDATE: 2/7/2023 - SB 49 passed the Senate and was sent to the House on 2/7/2023 and was referred to the House Rules, Calendar & Operations Committee.

SB 49 was reported favorably out of the Senate Education and Health Care Committees on 2/1/2023.  This bill is sponsored by Senators Galey, Lee and Barnes with 19 cosponsors. 

This bill enacts the Parents' Bill of Rights that includes, among other things, a parent has the right to seek exemptions allowed by state law:

"§ 115C-76.6. Parent legal rights for their child's education.

Parents have legal rights with regards to their child's education, including the following:

(2) The right to seek a medical or religious exemption from immunization requirements, consistent with the requirements of G.S. 130A-156 and G.S. 130A-157.

NVIC supports informing parents of their rights to exemptions to vaccines required for school but does not take a position on the sections not related to vaccines.
