SB 1029 was introduced and referred to the Senate Judiciary and Rules Committee on 1/30/2023.  The contact Senator on the Statement of Purpose is Senator Lenney. 

This bill prohibits child abuse investigations based on vaccination status by adding the following new section to Title 16 Juvenile Proceeding:

16-1618A. INVESTIGATION BASED UPON IMMUNIZATION STATUS PROHIBITED.

No investigation may be conducted pursuant to this chapter if it is based upon a child's immunization status.

This bill also prohibits a court from terminating parental rights based on vaccination status by adding the following to 16-2005. CONDITIONS UNDER WHICH TERMINATION MAY BE GRANTED:

(3) The court shall not grant an order terminating the relationship based upon the child's immunization status.

If passed the new law would go into effect on July 1, 2023.
