HB 5473 permits a minor 12 years old or older to apply on their own to obtain benefits for STD prevention, which includes Human Papillomavirus (HPV), Hepatitis A, & Hepatitis B vaccines.

HB 5473 amends Article V, related to medical assistance, under Chapter 305, related to public aid, to allow a minor who is 12 years of age or older to sign and file an application for the Article V family planning program enacted by Public Act 102-0665 amending Section 5-5. Public Act 102-0665 allows the department to provide coverage and reimbursement for all drugs that are approved/recommended by the Food and Drug Administration (FDA), federal Public Health Service (PHS), or the United States Centers for Disease Control (CDC) for pre-exposure prophylaxis and related services, including, but not limited to, HIV and sexually transmitted infection screening, treatment for STIs, medical monitoring, labs, and counseling. This bill amends that section of code, enacted by Public Act 102-0665, to add new language to Section 11-15 (2)(c), application requirements, that permits a minor who is 12 years of age or older to request family planning services, including vaccines for sexually transmitted diseases.

NVIC OPPOSES HB 5473 because it allows a minor to request and consent to vaccination without parental knowledge or consent. Vaccination decisions are best left to the parent of a minor who best knows their child's medical history, family medical history, potential contraindications to vaccination, and religious or conscientious objections to vaccination. A child may not fully understand the risks and benefits of vaccination in order to make a fully-informed decision on a vaccine. NVIC supports informed consent to vaccination and parental rights to be in control of vaccination decisions for their children. This bill undermines a parent's right to informed consent by allowing minors to obtain sexually transmitted disease "preventatives" such as HPV, Hepatitis A, and Hepatitis B vaccines without parental knowledge or consent. All vaccines are pharmaceutical products that carry a risk of injury and even death.
