SB 192 prohibits higher education institutions from requiring vaccines unless the institution allows for medical, religious, or personal belief exemptions. This bill is part of a broad higher education bill. NVIC does not take a position on any provisions in this bill that are unrelated to vaccines. 

SECTION 18. of SB 192 amends Utah Code §53B-3-103, related to the power of higher education board to adopt rules and enact regulations, to prohibit an institution from requiring proof of vaccination as a condition for enrollment or attendance within the system of higher education unless the board or an institution allows for a medical exemption or personal belief exemption if the student's claimed exemption is for a personal or religious belief. This amended subsection is renumbered §53B-3-103 (3)(b)(i). Existing code already prohibits a board of education from requiring proof of vaccination as a condition for enrollment. This bill expands that prohibition to the higher education institution itself. 

Renumbered subsection §53B-3-103 (3)(b)(ii) also prohibits an institution that offers both in-person and remote learning options from denying a student with a vaccine exemption from participating in an in-person learning option based on the student's vaccination status.   

Renumbered subsection §53B-3-103 (3)(b)(iii) excepts students studying in a medical setting at an institution of higher education from the provisions in these subsections. NVIC is OPPOSED to exempting medical students from these protections, but still supports the bill.

NVIC SUPPORTS SB 192 because it provides protections for higher education students from vaccine requirements and from discriminatory practices of separation or exclusion from in-person learning based on vaccine status. NVIC is opposed to all vaccine mandates and all forms of discrimination based on vaccine status. Vaccines are pharmaceutical products that carry the risk of injury and even death. Vaccination should not be a condition of receiving an education, even for students studying in a medical setting. An improvement to this bill would be to remove the exception for medical students. It would be even better to prohibit all vaccine mandates from all institutions of higher education, including teaching hospitals, rather than to allow vaccine mandates with exemption options.
