HB 1894 and SB 1903 define "drug" to also to mean food that contains a vaccine or vaccine material in the Tennessee Food, Drug, and Cosmetic Act.

HB 1894 and SB 1903 amend Tennessee Code Section 53-1-102 related to chapter definitions of Title 53, regarding Food, Drugs, and Cosmetics, through the following sections, as summarized:

SECTION 1. adds the definition of "drug" under Section 53-1-102(14) as subdivision (B) to also mean "food that contains a vaccine or vaccine material;"

SECTION 2. amends Section 53-1-102 to add a new subdivision defining "vaccine or vaccine material" to mean a substance intended for humans to stimulate the production of antibodies and provides immunity against disease, prepared from a disease, its products, or a substitute, treated to act as an antigen without inducing the disease, that is approved by the FDA.

These bills take effect immediately upon passage.

NVIC SUPPORTS HB 1894 and SB 1903 because they facilitate informed consent for consumers who do not want to consume food containing vaccine material. NVIC supports informed consent. Without reclassifying food that contain vaccine material, the consumer is unable to make an informed decision when they are choosing food for themselves and their family. An improvement on these bills would be to require labels on all products that contain any vaccine material. Some plants are now being genetically engineered to deliver mRNA vaccines. There is insufficient evidence to support the safety of vaccines for human consumption.
