Legislation Details:

HB 2368 was introduced in the House on 1/10/2024. This bill is sponsored by Representative Patty Lewis.

HB 2368 Repeals 2022 HB 2331 and 2022 SB 710, which currently prohibits a persons' COVID-19 vaccination status from being considered during the organ donor & recipient process, excluding lung transplants.

HB 2368 repeals the entirety of sections 1-2 under MO code 194.321, which refers to Recipients and donors, COVID-19 vaccination status not to be considered, when, exception.

NVIC OPPOSES HB 2368 because it removes protections from COVID-19 vaccination status discrimination currently in Missouri law and allows for discrimination based on COVID-19 vaccination status when considering organ donation or recipient eligibility.  Vaccines are pharmaceutical products that carry risks of injury and death.  Considering a person's vaccination status as a prerequisite for being able to receive a lifesaving transplant is coercion and it is morally wrong. Putting a person in a position of having to decide between a lifesaving surgery and violating their personal beliefs and putting themselves at risk for vaccine injury or even death, is unethical medicine.
