UPDATE: 2/13/2024 - HB 44 was referred to the House Labor, Health and Social Services Committee on 2/13/2024.

HB 44 was pre-filed on 1/4/2024 and introduced on 1/24/2024. The bill was sponsored by the House Labor, Health and Social Services Committee.

HB 44 repeals existing law which authorizes vaccination or medical treatment of a minor child without parental consent.

HB 44 repeals section 35-4-113 (b) (i) of code related to treatment when consent is not available;  quarantine as follows.

(b) During a public health emergency, the state health officer may subject a person to vaccination or medical treatment without consent in the following circumstances:

(i) If the parent, legal guardian or other adult person authorized to consent to medical treatment of a minor child cannot be located and consulted and the vaccination of or medical treatment for the minor child is reasonably needed to protect the public health or protect the minor child from disease, death, disability or suffering;

Upon passage, HB 44 will be effective July 1, 2024.
NVIC SUPPORTS HB 44  because it rightfully returns consent for vaccination to the parents of children in Wyoming. Children's brains are not completely developed to enable them to do a full benefit and risk assessment regarding vaccination decisions. This is important because vaccines are known to cause injury and death in some people.  NVIC does not take a position on the repealed section in the bill not involving vaccines.
