UPDATE: 3/9/2022 - SB 431 passed the House in an 88-11 vote, with an amendment that removed the emergency clause (a line in the bill stating "That an emergency exists and this act is in force from its passage). Bills that don't go into effect immediately in Virginia go into effect on July 1st following the legislative session.
UPDATE: 3/7/2022 - SB 431 was reported favorably out of the House Education Committee on 3/7/2022 with an amendment with at 20-2 vote. The amendment removes line 17 which is the emergency clause. 17 2. That an emergency exists and this act is in force from its passage.

UPDATE: 2/5/2022 - SB 431 was reported favorably out of the Senate Committee on Education and Health by a vote of 10 yes and 4 no as a substitute on 2/3/2022. The substitute is an improvement over the introduced version, however it's not clear what guidelines would be recommended for those who have simply been exposed to COVID-19 but have not contracted it. NVIC Advocacy will continue to watch.

1. § 1. That the Department of Education, in collaboration with the Department of Health, shall (i) recommend options for isolation and quarantine for students and employees at public schools who contract or are exposed to COVID-19 and (ii) develop guidelines for such schools and recommend such guidelines for use as an alternative to quarantine. All guidelines established pursuant to this act shall be immediately distributed to local school boards and shall reflect the most updated recommendations to limit the amount of time out of the classroom, including options for no quarantine, as recommended for asymptomatic individuals.

SB 431 was introduced and referred to the Senate Committee on Education and Health on 1/12/2022. This bill is sponsored by Senator Dunnavant
This bill requires the Board of Education, in collaboration with the Department of Health, to (i) recommend as best practice the shortest duration of quarantine possible, as recommended by the Centers for Disease Control and Prevention, for students and employees at public schools who contract COVID-19 and (ii) develop test-to-stay guidelines for such schools and recommend such guidelines to schools for use as an alternative to quarantine for students and employees who contract COVID-19. The bill also provides that all guidelines established pursuant to the bill shall be immediately distributed to local school boards and shall reflect the most updated recommendations from the Centers for Disease Control and Prevention to limit the amount of time out of the classroom to be as short as possible, including no quarantine, as recommended for asymptomatic individuals who have been fully vaccinated either within six months or have a boosted vaccination status. The bill contains an emergency clause.
