UPDATE: 5/15/2024 - SB 402 was reported in the House Health, Human Services, and Elderly Affairs Committee with the Majority Committee Report recommendation of "Ought to Pass with Amendment" by a roll call vote of 14-6 and the Minority Committee Report recommendation of "Inexpedient to Legislate" on 5/15/2024. The Majority Committee Report Amendments (2024-1810h) make technical restructuring and clarification changes to the provisions, however, SB 402 as amended, still allows a pharmacist, pharmacy intern, or pharmacy technician to administer vaccines licensed by the FDA & recommended by ACIP to individuals 18 & up. UPDATE: 2/21/2024 - SB 402 was recommended "Ought to Pass with Amendment" # 2024-0825s with a 5-0 vote by the Senate Health and Human Services Committee on 2/21/2024. The Amendment adds the qualification to the vaccines that can be administered that they are also recommended by the United States Centers for Disease Control and Prevention Advisory Committee on Immunization Practices or a successor organization.
This amendment necessitated a title change for the bill post for SB 402 from "Allows a pharmacist, pharmacy intern, or pharmacy technician to administer vaccines licensed by the FDA to individuals 18 & up" to "Allows a pharmacist, pharmacy intern, or pharmacy technician to administer vaccines licensed by the FDA & recommended by ACIP to individuals 18 & up".
SB 402 was introduced in the Senate and referred to the Senate Health and Human Services Committee on 1/3/2024. This bill is sponsored by Senator Regina Birdsell.
SB 402 allows a pharmacist, pharmacy intern, or pharmacy technician to administer any vaccines licensed by the FDA to individuals eighteen (18) and older.
SB 402 amends RSA 318:16-b, regarding pharmacists and pharmacies, currently allows a pharmacist, pharmacy intern, or pharmacy technicians a certain list of vaccines. SB 402 would change this list of vaccines to any FDA approved vaccine and is summarized as follows:
Allows a pharmacist, pharmacy intern, licensed or certified pharmacy technician, under the supervision of an on-site vaccination pharmacist can administer any Food and Drug Administration (FDA) approved vaccine to anyone 18 years of age or older, so long as the Centers for Disease Control and Prevention (CDC) do not recommend against the administration of the vaccine.
SB 402 takes effect sixty (60) days after passage.
NVIC OPPOSES SB 402 because it puts the health and safety of those receiving vaccines at risk. Pharmacists do not have the medical training or knowledge of family and personal medical history to screen for contraindications, pharmacies are not equipped to deal with vaccine adverse reactions, and pharmacists do not have the necessary medical training to be able to tell the difference between cardiac arrest, anaphylaxis, fainting, and act accordingly to save the lives of individuals who react at the time of vaccination. This bill also expands the amount of vaccines that pharmacists can administer, undermines the doctor patient relationship, and removes critical health history screenings prior to vaccination.
