HB 2759 and SB 1429 require testing of donated blood for COVID-19-related vaccine and any other mRNA-based vaccine components, including spike protein and lipid nanoparticles. If the blood tests positive, it must be labeled, and the person receiving the transfusion must be informed and given the chance to refuse it.
HB 2759 and SB 1429 amend Chapter 191, regarding health and welfare, to add a new section that outlines the requirements for labeling and testing of donated blood, summarized as follows:
SECTION 191.763
1. Defines terms, including "blood bank" to mean any institution or place that provides a system for the collection, processing, storage, distribution, or administration of whole human blood or its component parts.
2. Requires a blood bank to test donated blood for evidence of any COVID-19 vaccine or other messenger ribonucleic acid (mRNA) vaccine components, including evidence of lipid nanoparticles and spike protein from a vaccine.
3. Establishes that if the blood tests positive for evidence of any of these components, the following procedure must be conducted: (1) Requires the person withdrawing or separating the blood to label the blood to reflect that it has tested positive and (2) prohibits any person from administering positive status blood unless the container of blood contains the required label and the person receiving the transfusion or their representative has given informed consent to use the positive status blood with the option to refuse said blood.
NVIC SUPPORTS HB 2759 and SB 1429 because they facilitate the full consent of an individual who does not want mRNA particles injected into their body. NVIC supports informed consent, which includes the right to refuse. Without labeling donated blood containing mRNA-related components and allowing a person to refuse that blood, a person is unable to make an informed decision when receiving a blood transfusion. Florida's Surgeon General Joseph Ladapo made a call to halt the use of mRNA COVID vaccines due to the FDA's inability to provide evidence that there is no harmful DNA contamination in mRNA-based vaccines in January 2024. An improvement to these bills would be to levy penalties against blood banks that do not comply with the labeling requirements provided for in these bills. There is insufficient evidence to support the safety of mRNA-based vaccines for humans.
