HB 46 prohibits any public or nonpublic school from requiring the COVID-19 vaccine as a condition of enrollment or attendance. 

HB 46 amends Louisiana Revised Statutes 17:170, related to the immunizations required for school and day care attendance and electronic transmission of compliance reports, to include a new subsection (A)(4) that prohibits any public or nonpublic school or facility listed in Paragraph (1) of this Subsection (including licensed day care centers, elementary and secondary schools, and colleges and universities from requiring the COVID-19 vaccine as a condition of enrollment or continuing attendance. 

NVIC SUPPORTS HB 46 because it protects a student and their parent or guardian's right to informed consent, which includes the right to refuse the COVID-19 vaccine without discrimination, coercion, or threat of punishment. This bill protects the student and their family from being forced to take an unwanted or unneeded vaccine that lacks long-term safety studies. NVIC opposes all vaccine mandates. All vaccines are pharmaceutical products that carry a risk of injury and even death and should not be a condition of receiving an education. An improvement to this bill would be to prohibit all vaccine requirements for public and nonpublic schools and day cares, not just the COVID-19 vaccine.
