HB 115 requires blood donors to disclose if they received a COVID-19 vaccine, requires blood to be conspicuously labeled if donated by a COVID-19 vaccinated individual, and establishes the right of an individual to request non-COVID-19 vaccinated blood.
HB 115 creates a new chapter of code under Title 35, related to public health and safety, to be numbered §35-34-101, that requires blood donors to disclose if they have received a COVID-19 vaccine, requires blood to be conspicuously labeled as containing COVID-19 vaccinated blood, and establishes an individual's right to request non-COVID-19 vaccinated blood summarized as follows:
(a) Requires any person who collects human blood for donation to disclose whether the donor has received a COVID-19 vaccine or a messenger ribonucleic acid vaccine during the donor's lifetime.
(b) Requires blood donated from a donor who received a COVID-19 vaccine or messenger ribonucleic acid vaccine to be conspicuously labeled.
(c) Establishes the right of an individual in a non-emergency situation when receiving a blood transfusion, to request blood from a non-COVID-19 or messenger ribonucleic acid vaccine vaccinated blood donor, as long as the blood is available.
If passed, HB 115 will become effective on July 1, 2024.
NVIC SUPPORTS HB 115 because it helps individuals receiving blood products, including those with religious or conscientious beliefs, to make better informed decisions on receiving blood by requiring the labeling and disclosure of any blood donations containing COVID-19 or other mRNA product vaccinated blood. There is not sufficient evidence to support the safety of COVID-19 vaccines and how they affect the blood of vaccinated individuals. This bill allows individuals to choose whether or not they will receive COVID-19 vaccinated or other mRNA vaccinated blood during non-emergent blood transfusions. NVIC supports informed consent for all individuals, including the opportunity to consent to any biological product containing mRNA vaccine or COVID-19 vaccine byproducts and the right to refuse said products.
