HB 643 prohibits the manufacture, sale, delivery, holding, or offering for sale of food containing mRNA vaccine or material unless the product is conspicuously labeled.

SECTION 1. of HB 643 amends §75-35-15, regarding food labeling requirements to add the following two subsections as summarized:

Subsection (6) prohibits the manufacture, sale, delivery, holding, or offering for sale of any food that contains a messenger ribonucleic acid (mRNA) vaccine or vaccine material unless the label contains a "conspicuous notification" of the vaccine or vaccine material in the food product. This subsection defines "mRNA vaccine or vaccine material" to mean a substance intended for humans to "stimulate the production of antibodies and provide immunity against disease, prepared from the causative agent of a disease, its products, or a synthetic substitute, treated to act as an antigen without inducing the disease" that is approved by the FDA.

Subsection (7) clarifies that nothing in Section 75-35-15 or any other law prohibits labeling meat products as "mRNA free" or similar labeling if the animal from which the product was derived was not administered an mRNA vaccine or vaccine material.

HB 643, if passed, will take effect from and after July 1, 2024.

NVIC SUPPORTS HB 643 because it facilitates informed consent for consumers who do not want to consume food containing animals who have been given mRNA vaccines. Without labeling these food products as containing mRNA-vaccinated animal matter, the consumer is unable to make an informed decision when they are choosing food for themselves or their family. NVIC supports informed consent. An improvement to this bill would be to prohibit the sale of any food product, not just meat, that contains mRNA vaccine by product unless conspicuously labeled and include penalties for mislabeling. Plants are now being developed to deliver mRNA vaccines. There is insufficient evidence to support the safety of mRNA-based vaccines for human consumption.
