SB 1975 prohibits forced medical procedures including a vaccine and prohibits discrimination based on personal medical decisions or medical procedure refusal. This is part of a larger Citizen’s Bill of Rights which also covers limitations on digital identification, tracking, and artificial intelligence.

SB 1975 creates a new section of law, Section 12007, under Title 74, related to state government, and does the following as summarized:

SECTION 1. titles Section 12007 as the "Citizen's Bill of Rights".

SECTION 2. creates new statute codified as 12007.1 to establish (1) the definition of "citizen" and "citizenry" to mean a U.S. citizen who is a resident of the state and (2) define "government" or "governmental" to mean any state or federal level government entity.

SECTION 3. Subsection C (1), establishes that any financial, governmental, or commercial institution shall not deny any resident of the state goods and services based on race, ethnicity, sex, gender, age, political party, party affiliations, interests, or personal medical decisions.

SECTION 6. creates section 12007.5 to establish the following:

"Government, business, or any agent representing such shall neither force any citizen to take a medical procedure including a vaccine, nor penalize citizens or deny their unalienable rights, or otherwise restrict their employment, movement, and associations, if they decide not to have a particular medical procedure performed."

SECTION 10. creates section 12007.9 to establish penalties for any government, business, or financial institution that violates any provisions of this act, summarized as follows:

Any entity or individual shall be held liable for such violation by a court of competent jurisdiction and must show just cause for the violation. The entity or individual violating these provisions shall pay for any legal fees for citizens affected by their violation, even prior to final judgement. If found guilty, the entity or individual shall be responsible for payment of restitution which will be determined by the court of competent jurisdiction.

SB 1975 shall become law upon passage.

NVIC SUPPORTS SB 1975 because it allows individuals the freedom to choose whether or not they will take any vaccine without fearing discrimination. NVIC opposes all vaccine mandates and supports protection from vaccine status discrimination. Vaccines are pharmaceutical products that carry risks of injury and death. The language in this bill not only provides protection from vaccine mandates and discrimination, but also ensures that an individual is not denied products or services due to their medical decisions. These decisions include a person's vaccination status and their decision to use any type of implantable medical device that could track vaccination status or medical records. NVIC does not take a position on other provisions in SB 1975 that are not related to vaccines.
