SB 1285 was introduced in the Senate on 1/3/2024. The bill is sponsored by Senator Nick Schroer.

SB 1285 is improving informed consent for those who want to avoid consuming foods containing animals vaccinated with mRNA vaccines by enacting a fine if foods are not appropriately labeled. 

SB 1285 repeals three (3) Sections of Missouri Code within Title XII Public Health and Welfare: section 196.025 related to punishment for violations and exceptions; section 196.050 related to restrictions on regulations that are more stringent than prescribed by federal act; and section 196.075 related to food and when it is deemed misbranded. SB 1285 then adds three (3) new sections of code to be known as sections 196.025, 196.050, and 196.075 replacing and renumbering existing code to modifies the penalties for false or misleading advertisement and labeling, specify exemptions to said penalties, prohibit the Department of Health and Senior Services from establishing stringent standards for regulation of commodities beyond any federally prescribed standards, and specify the criteria for mislabeling, misbranding, or falsely advertising food. 

NVIC supports the addition set forth in section 196.075 of SB 1285 that will add to existing code 196.075 related to the mislabeling of food to include the following subsection:

196.075 A food shall be deemed misbranded if it complies with the following set of criteria: 

(13) "If it contains, in whole or in part, meat food products derived from an animal vaccinated with a messenger ribonucleic acid-based vaccine, unless the product packaging state, in at least fifteen-point uniform bold type, 'MRNA VACCINATED.'"     

The bill also clarifies that the existing fine of up to $1000 would apply "for each incident or for each prohibited product offered for sale in Missouri."

NVIC SUPPORTS SB 1285 because it will facilitate informed consent for consumers who do not want to consume food containing animals who have been given mRNA vaccines by requiring all food containing any messenger ribonucleic acid-based (mRNA)-vaccinated animal products to be clearly labeled so that consumer is informed of the food contents and can make an informed choice before consuming the product that contains mRNA-vaccinated animal matter. NVIC supports informed consent. Without labeling these food products as containing mRNA-vaccinated animal matter, the consumer is unable to make an informed decision when they are choosing food for themselves or their family. There is insufficient evidence to support the safety of mRNA-based vaccines for human consumption. NVIC does not take a position on any other part of SB 1285 not related to the labeling of food containing mRNA-vaccinated animals.
