This amendment adds the following new subdivisions, summarized as followed:

SECTION 1. of S2726A adds new subdivision 6-b. to Section 1394 of Public Health Code, related to children’s camps; standards and regulations, that requires all staff at all children’s camps defined in Section 1392 of this article to provide a camp operator with a current certificate of vaccination for diphtheria, measles, meningococcal meningitis, mumps, pertussis, rubella, tetanus, and varicella. 

SECTION 2. of A2186A adds new subdivisions 4 and 5 to Section 398-f of the General Business Law related to children’s non-regulated camp, that is summarized as follows:

Subdivision 4. requires every non-regulated camp to ensure that each child enrolled provides proof of vaccination for poliomyelitis, mumps, measles, diphtheria, rubella, varicella, Haemophilus influenzae type b (Hib), pertussis, tetanus, pneumococcal disease, and hepatitis B. Medical exemptions from a licensed health practitioner, as defined in Section 2164 of the Public Health Code, are accepted until the requirements of this section are found no longer to be detrimental to the child’s health.

Subdivision 5. requires staff at all children’s non-regulated camps to provide a camp operator with a current vaccination certificate for diphtheria, measles, meningococcal meningitis, mumps, pertussis, rubella, tetanus, and varicella. Medical exemptions from a licensed health practitioner, as defined in Section 2164 of the Public Health Code, are accepted until the requirements of this section are found no longer to be detrimental to the individual’s health.

This amendment makes S2726A and A2186A identical and NVIC's position remains as OPPOSE. This amendment necessitates a title change to S2726A in NVIC's bill post from “Mandates certain vaccines on children's camp attendees, with medical exemptions” to “Mandates certain vaccines on children’s camp attendees and staff, with medical exemptions.” 

UPDATE: 6/6/2024 - A2186A failed to be scheduled for a vote in the Assembly Health Committee before the NY Legislature went into recess on 6/6/2024; however they could be called at any time before session ends on 1/2/2025.

This amendment does not change NVIC’s position to A2186A. NVIC OPPOSES this bill and this amendment. This amendment necessitates a title change to A2186A in NVIC's bill post from “Mandates certain vaccines on children's camp attendees, with medical exemptions” to “Mandates certain vaccines on children’s camp attendees and staff, with medical exemptions.” S2726 has not changed and the title remains "Mandates certain vaccines on children's camp attendees, with medical exemptions."

These bills require children attending overnight, non-regulated, summer day, or traveling summer day camps to be vaccinated against the following:
Polio, mumps, measles, diphtheria, rubella, varicella, haemophilus influenzae type B (Hib), pertussis, tetanus, pneumococcal disease, and hepatitis B. The bills allow medical exemptions.

NVIC does not support vaccine mandates.

If passed, these bills would become effective October 1, 2023.

These bills are the same as A6961/S4249, which were introduced by the same sponsors in the 2022 legislative session.
