Prohibits state and local enforcement of federal COVID-19 vaccine mandates, with health care facility exception

UPDATE: 7/1/2022 HB 1455 was signed by the Governor and enacted as Chapter 305, effective 7/1/2022. 

UPDATE: 6/22/2022 - HB 1455 passed and was enrolled on 6/22/2022. The enrolled version of the bill prohibits state and local governmental entities from enforcing any federal laws, orders, or rules which would require someone to get COVID-19 vaccine or to submit a negative COVID-19 test more than once a month as a condition of employment or any other activity. There is still an exception for health care providers which are subject to a federal mandate.

Specifically, the state and local government agencies are prohibited from:

  1. Investigating or penalizing a violation of the mandate;
  2. Assisting a federal department or agency with investigating or penalizing a violation of the mandate; or
  3. Providing the COVID-19 vaccination status of a person to the federal government regarding an investigation of a violation of the mandate.

UPDATE: 5/13/2022 - House concurs with Senate amendment to HB 1455.

UPDATE: 5/6/2022 - HB 1455 passed the Senate in a 13-10 vote.

UPDATE: 4/27/2022 - HB 1455 passed the Senate Health and Human Services Committee with an amendment that adds the following exception to the bill:

III. Paragraphs I and II of this section shall not apply to any health care facility, provider, or contractor subject to a federal vaccine requirement including the survey and certification policies and procedures under the authority of the department of health and human services, bureau of licensing and certification.

Because of this change, NVIC Advocacy has added "with health care facility exception" to the bill title.
