Description:

The governor of Arizona issued Executive Order 2021-19 on 10/7/2021. In the order, the governor cites A.R.S. § 36-782(A), and states that this authorizes him to issue an Enhanced Surveillance Advisory. This statute is in the Arizona Public Health and Safety Code, and allows the governor to issue such an advisory when an epidemic or pandemic disease has occurred or may occur.

 

An enhanced surveillance advisory allows for heightened tracking of data for public health purposes. The order cites other portions of the Arizona Public Health and Safety Code as its authorization to carry out specific actions related to COVID-19 vaccination data. In this regard, the order:

 

(1)  Directs the Arizona Department of Health Services (ADHS) to collaborate with the Federal CDC and HHS by sharing Arizona’s COVID-19 immunization and vaccine administration information with these agencies and other public health entities.

(2)  Directs individuals and entities which administer COVID-19 vaccines to report the certain information to ADHS every 24 hours, including information such as:

 

a.    An individual vaccine recipient’s name, date of birth, gender, race/ethnicity, residential address, phone number, and vaccine priority group;

b.    The route of administration and administration site on the patient’s body; and

c.     Proof that an individual vaccine recipient was provided with follow up information if a second dose is required.

 

(3)  Directs ADHS to collaborate with other entities to make all COVID-19 related data (including COVID-19 vaccine information) available for certain purposes, including treatment, care coordination, and case management. This information may be shared regardless of whether individuals have opted out of having their personally identifying data shared with health information organizations.

 

 

In addition, the order prohibits the state, cities, towns, and counties from implementing COVID-19 vaccine mandates, but states that health care institutions may require their employees to be vaccinated.
