Description:

UPDATE: 1/24/2017 - HB 1043 was tabled in the Committee on Health and Human Services on 1/19/2017.  This bill is dead for this session.

HB 1043 was introduced on 1/10/2017 and referred to the Committee on Health and Human Services.  This bill is sponsored by the Committee on Health and Human services at the request of the Board of Pharmacy.  HB 1043 was scheduled for a hearing on 1/17/2017 but was deferred to 1/19/2017.    The bill will be heard in the Committee on Health and Human Services on 1/19/2017 in Room 412 at 7:45 AM.

This bill would change the makeup of the current Board of Pharmacy and allow them to make the rules concerning the practice of pharmacy which would include immunizations.

36-11-11. The Board of Pharmacy board may promulgate rules, pursuant to chapter 1-26, as follows:

       (1)    Pertaining to the practice of pharmacy, including immunizations;

Currently pharmacists can only administer flu vaccines to adults.  See page 91 of the South Dakota Pharmacy Law Book - http://doh.sd.gov/boards/pharmacy/assets/SDLawRules2016.pdf 

This bill leaves the practice of pharmacy, including immunizations wide open to whatever rules this new board adopts and should be opposed.
