Description:

UPDATE: 6/19/2017 - HB 1386 and SB 808 failed to move forward in the 2017 legislative session that ended on May, 29, 2017, however bills can carry over to the 2018 session.

UPDATE 2/3/2017: SB 808 will have a second reading on 2/7/2017 and was referred to the Senate Committee on Health and Human Services.

HB 1386 is scheduled for a first reading on 2/6/17 and referred to Appropriations and Budget.  This bill is sponsored by Rep. GannSB 808 is the senate version and is also scheduled for first reading on 2/6/2017.  This bill is sponsored by Senator Dahm.

These bills would enact the Parental Rights Vaccine Act which would require:

Each health care provider who administers a vaccine set forth in the Vaccine Injury Table, as established by the United States Department of Health and Human Services, shall obtain informed consent from the legal representative or other adult authorized by law to consent on behalf of a minor of any child to whom such provider intends to administer such vaccine.

Prior to administering the vaccine, the health care provider shall provide relevant information regarding benefits and risks of the vaccine as well as information concerning the National Vaccine Injury Compensation Program. Providing a copy of the Vaccine Information Statement, the source of which is clearly identified, and making available for review the Centers for Disease Control and Prevention's "Epidemiology and Prevention of Vaccine-Preventable Diseases: Vaccine Excipient and Media Summary" to the legal representative or other adult authorized by law to consent on behalf of a minor shall constitute a minimum standard of relevant information.

This bill is similar to HB 3016 that was vetoed by the governor in 2016.
